You have the option to approach either a civil court or the Debt Recovery Tribunal (DRT) to request a stay on the ongoing proceedings. By doing so, you can temporarily halt the legal process and gain time to explore other solutions, such as mediation or settlement discussions with the bank.
In civil court, you can file a suit and request an interim stay order to prevent further action until the dispute is resolved. Alternatively, the DRT specializes in matters related to debt recovery and may be a more suitable venue if your case involves significant amounts of unpaid loans or financial disputes with a bank or financial institution. In either forum, obtaining a stay would allow you to negotiate or seek mediation with the bank, which might result in a more favorable outcome, such as a revised repayment plan or settlement.
It’s important to assess which forum is best suited for your case. The civil court typically handles a broader range of disputes, while the DRT focuses specifically on loan defaults and related financial issues. Seeking legal counsel is advisable to guide you through the process and ensure that your rights are protected while negotiating with the bank. Mediation can offer a more amicable resolution without prolonging the litigation process.
