Validity period of a a/c payee cheque given

29-Oct-2023 (In Banking / Finance Law)
Sir , I had deposited a cheque drawn on standard chartered Bank Delhi dated 27/07/2020 in my bank in Solan Himachal Pradesh on 26/10/2020 . My bank has send it in clearing on 26/10/20 itself .The cheque was returned saying it is invalid / stale on 29/10/20 .My doubt is that the cheque is valid for 3 months & I had deposited it well within 3 months time . Pls clear my doubts about cheque validity and do I have any legal course left for the recovery of my money

Hi,
Yes, the validity of the cheque is 3 months from the date mentioned on the Negotiable Instrument. Since it has been returned unpaid for the reason invalid / stale it must have been recieved by the clearing bank 1 or 2 days after its validity. Yes, you have an option to file a civil suit for recovery with the concerned court
