Tenant living in my property has turned a loan defaulter

I m Hindu . It is loan defaulter case of tenant who was living in my flat . He took loan by showing address of residence as my flat. Later he vacated the flat. Now one by one bank, court notice, lawyer s notice is coming on his name in my flat. So who is to blame for this. Bank or me . What will be the steps of the bank and legal proceedings in this case. What should I do

Hello,

You do not have to worry, since the loan has not been taken against your property, you are not liable for the acts of your tenant, you are the house owner, it doesn't mean that you are liable to pay the amount on behalf of the tenant. You are innocent and you don't have to worry at all.

As a precaution you can publish a disclaimer in the newspaper that you are not responsible for any of the loan taken by your tenant and also you duly reply to the notices that are being received by you.

You may approach a lawyer in person and get him to draft a representation starting the facts clearly and mentioning the legal points as well. This should be the first step and should be done on priority so that bank is aware of the same.

Sir do you have a rent agreement executed. It is a case of fraud. You have to file a case of fraud on the tenent yourself also. As it prove yoir bonafide. You should also reply to the notices if any which are sent to you the bank or the lawyer.
