Procedure when the notice for recovery is served by credit society?

I am received loan for business from credit society. And my business is lost from the time and i close it.. and my payment from the day is irregular. Then society is claim against me for recovery... and noticed me from one of the private advocate... then i will to say I will pay all recovery but plz give me side for few days... he is disagree. And case file against me for cheque bounce... so i will unsatisfied... I have help sir.

If you did not had the money why did you issue cheque to society? Further as you had issued cheque opposite party has every right to initiate case against you.

Since you have issued a cheque knowing the fact that there is no balance in the account is an offence and you are liable for criminal prosecution for cheque bouncing. But, nevertheless you can appear before the court and admit your liability and request the Court that you want to make payment but need sometime for the same as you are in genuine difficulty. Then Court may grant you sometime for payment, but be sure that once the Court gifs you time then you have to make payment within that time else you will not only be liable for cheque bouncing but you will also be liable contempt of court order.
