Bank deducted EMI without amount being credited in my account

Recently my loan amount was sanctioned with Capital First Finance company and not credited in my account, but 1st EMI has been debited from my account.I informed to executives and accountants, but no proper response.
initially a legal notice has to be issued for recovery of the 1st EMI that is debited from your account, in case the capital first finance company fails to adhere to the legal notice, then file a consumer case
