ATM gave me less cash, no response from bank. What can we do legally

I am an axis bank customer who made an ATM transaction at ICICI Bank. I punched in 8000 rs. And the same got debited from my savings a/c the same moment but only a note of rs.2000 got dispensed from ATM. Since then(10-2-2017) I have been calling up their customer care, visiting their branch but all in vein. Filed a case in consumer court. Need my money back and compensation from both the banks for all the mental harassment n humiliation they have caused to me. Kindly advise

Usually in such unsuccessful transaction money is reverted back in the account. In your case as you mentioned only ₹2000 was dispensed and ₹8000/- was debited. You have also mentioned that both the banks have not been able to help you out. A consumer complain had also been filed by you.
In case your consumer complain is still not listed you should write to the bank ombudsman and talk to the bank managers of Axis and icici. Secondly if there was no reply from bank then you should have sent a legal notice.

I hope you have filed all documents including the transaction slip, bank statement along with your consumer complaint. The consumer complaint should ideally contain your claim for refund and compensation. No separate action need to be filed. You may try writing to the higher authorities in the banks such as the MD, Chairman etc. You may also try approaching the banking ombudsman by way of an online complaint (subject to ombudsman discretion to take cognizance).
