As per AIr force act 1950 sec 73 notes 10.2 A COURT MARTIAL DOES NOT DEAL WITH ACTING RANK when court martial concluded I was acting sergeant rank in air force

That specifically deals as to whether the Court Martial can be concluded for acting ranks or court marital proceeding cannot be initiated for acting ranks. if the provision clearly bars the above court marital then the same will be challenged on technical ground otherwise it has to be challenged on merit of the case.
