23-Jul-2023 (In Arbitration Law)
One party has invoked arbitration clause but has not served arbitration notice. Is there any time period for serving arbitration notice?

Where a Section 9 Petition has been filed by the Claimant and interim relief has been granted, the arbitration proceedings must be commenced (i.e. the notice must be issued) within a period of 90 days from the date of such order granting interim relief or within such further time as the Court may direct. This is evident from a bare perusal of Section 9(2) of the Arbitration and Conciliation Act (as amended).
