Land Acqisition by NHAI Authorities - Arbitration Proceedings - Reg.

01-Aug-2023 (In Arbitration Law)
Some of my Land was acquired by the Competent Authority Land Acquisition Bandar on behalf of NHAI in 2016 through paper publication and later compensation has been paid and was received under protest. Subsequently, the case was referred to the Arbitrator, Joint Collector-II, Krishna District by the Competent Authority Land Acquisition, Machilipatnam for enhancement of the compensation on 31-05-2018. Later, we requested the Arbitrator to allow us to appoint our own arbitrator under Sec.10 & 11 of the Arbitration and Conciliation Act, 1996. Several representations were made in this regard. No communication from the said Arbitrator till now. More than one year two months have been lapsed. I don't Know whether the said arbitration proceedings are still pending or not. Now what shall I do. What should be my plan of action in this regard. What is the limitation for Arbitrator to consider my case and to dispose the same. Please advise me properly in this regard.

hi
please check with the arbitrator whether any order has been passed on your representation for appointment of another arbitrator. because it is a land acquisition case and proceedings are for enhancement of compensation, in all probability, your representation was rejected. your remedy lies in filing appeal under section 34 of arbitration act challenging the compensation itself
