Questions Answered by Advocate Virat Tomar

Q: What to do if the college gave me a cheque and that dishonored

I was on the faculty of a college and they paid me by a cheque which was not honoured by the bank for lack of funds. The same was duly informed to the paying authorities and was promised a new cheque/ money transfer to my account. It's been over Four Years and I have yet not received the payment despite reminders.

Advocate Virat Tomar answered
As you did not send a legal notice within 30 days of the bouncing off the cheque, you are barred by limitation to file a case under section 138 i.e. complaint against bouncing off cheque. However you can still file a civil suit for recovery of money.

Q: Procedure to own son and his wife disowned from property.

Hi I have disowned my son his wife and grandson in 2013 by issuing public notice in newspaper due to certain misunderstandings and have disowned him from my property as well. Now I wish to owe him back and give his share in property want to make all required changes legally at the time I am alive please tell me the required procedure and also advise if those paper cuttings are required because I am afarid I am not having them

Advocate Virat Tomar answered
Hi,‘Disowning’ a son is not recognized per se by the Indian legal system. The real legal question here is, whether you have disowned your son from your Ancestral or Self-Acquired property? If the property is your self acquired property then you can transfer your property to anyone you wish to, by the means of will, or you may gift it to any person including your son.In all the properties which are of ancestral in nature he has the right to his share which can not be ignored by any means.Just make a will in your son's favor and this will take care of all the complexities if any.For further legal assistance on nominal charges, you can have my Phone Number and Office address from Lawrato.Advocate Virat Tomar
