Q: Son's right on grandfather's property if father is not alive

My husband who is following his mother's faith( Christianity) but his father did not convert..he was a Hindu...and is not alive.My husband's uncle who is a hindu is not giving my husband his right saying that your father had converted and he is not alive now...and you being a Christian don't have any right in the property...Can my husband get right in his grandfather's property since his dad is not alive

Following a particular faith is quite different from actual conversion from one religion to another religion, i.e. in your case from Hindu to Christianity. You need to be specific if he has baptised and actually converted to Christianity.

Q: How to get bail in the case of sec 326 from court

If the investigation officer has written points against us in the I.O.say . Can we get bail from magistrate court? If no then can we get bail from session court?

Though Sec 326 is a Cognizable Non-bailable and non-compoundable offence, bail is a right and jail is an exception. However, it also depends on the case at hand. Whether the person is arrested or apprehending arrestYou can approach Magistrate FC with an application for the same and if it gets rejected, you can approach the Sessions Court but not on similar grounds, else the bail will get rejected.

Q: Flat Purchase

Hi I am Mahendra, I purchased flat two years back. As per RERA passession date is Dec 2018, but still the pinch work is going on. I am paying pre EMI. Just want to know what I can do? Can I send notice to builder?

Mahendra, have you?1. Executed registered Agreement for Sale document with the Builder?2. Does the document specify date of possession of the flat?3. Availed any housing loan on this flat?4. Paid maximum amount to the Builder wherein you know that you're trapped?File a complaint against the Builder with RERA and rest RERA will take care of.

Firstly, find out if the property is a RERA registered property.Secondly, ask the Builder to provide you all the documents related to the property.Thirdly, if you are availing home loan through some Bank, the Bank will inform you of legal issues, if any.Finally, visit a Property Lawyer who can perform a Search Opinion Report for your property apart from the Bank doing the same for you.

Dear sir,I an central government employee,in 2012 I purchased a plot in Pune wagholi area is wadebolia village next to kesanand phata.i hv legal sale deed,but not having 7/12.that time agent told me 7/12 would be done few years later,it was agricultural land that time,he will get NA status.Now I need 7/12

Firstly, find out if your purchased plot has been converted to N.A., by visiting the Sub-Registrar's Office where your purchased plot is situated. Secondly, I would like to know if your Sale Deed is a registered document. If not, you can still register the same by paying today's market value of the plot along with penalty, the ready reckoner of which is available with the Sub-Registrar's Office. Finally, you can obtain 7/12 from the same Sub-Registrar's Office by paying a nominal amount.
