Q: Clarification /guidance in divorce case

I am Shankar (41) Hindu got married my wife (34) in 2010 having a daughter aged 10+ yrs. In June 2021 my wife went to her parents village with our child. Also she filed divorce case in Nagercoil Court . On summoning I attended 3+ hearings also counselling session.She is not pacified on my requests. She is stubborn in getting divorce, but I do not want divorce.Suddenly she married another man in her village in Dec 2021 before getting legally divorce. Now they are living together. I did not complain considering shame.Now I want to be guided in the following. 1. Whether I can claim my daughter with me thr court. 2.If I lodge complaint with Police what will be the position. 3.If I give my concern for divorce whether I have to pay alimony/ maintenance. ( I am not regularly employed) what else she can claim from me. I want my child. Pl guide

Dear Shankar,1. you can claim your daughter,If you prove that your wife was in illicit relationships living a immoral life against to law which definitely spoils your daughter's future2. you can also file a police complaint in concerned police station against your wife and book her under bigamy.3. if you proved that your wife was in adultery or bigamy you no need to pay any maintenance but as for your daughter is concerned you definitely have to pay a suitable maintenance amount in respective of your status and income.

Q: Husband is having an affair with another woman, what to do

My husband in Dubai,am Karaikal,last one year he did not contact me,changed number,didnot send any money to me.his mother and sister treated me very badly,after long searching of his number,i got his number and called him first he attend the call he said am not interested to talk to you and living with you,and cut the call,again I called him one lady attend the call,she is scolding me ,I attend suicide,but husband he didn't try to see me,now one of my friend says my husband affair with another Indian women,what I do

Yes sister, sorry for you situation.It is not clear what is your religion.Any have you may right to file a maintenance petition against your husband for deserting you.Then you may prefer a complaint under bigamy.

Q: Complaint against insurance officer for being irresponsible.

While admitting my mom at the hospital for a surgical procedure, the age of my mom was taken wrongly in their records. Post discharge after consulting this with my insurance company, I had requested the hospital staff to provide a letter confirming the identity of the patient. Instead of helping with the letter, the officer was irresponsible and behaved in a very rude manner. Please advise how can I handle this.

Sir. Immediately issue the legal notice clearly stating the mistake what they have done. Demanding to rectify the mistake unconditionally.failing in which you may sue them in consumer forum for damages.

Q: Motor Purchase Agreement - Party Not Returning The Advance Amount

Dear Sir/ Madam, I given advance 12lakhs to one person for purchase 2 buses. I gave 2 times by splitting the amount 5lakh, 4 lakh and 3 lakh already he has to give me. When I gave 5 lakh he gave one agreement to get sign from me. In that he put advance amount 5 lakh and settlement date was within 50 days but I asked 60 days time then he accepted but he said agreement is just formality to show to my wife. so that I believed him and put signature. He kept with him original copy and said next day will give the xerox copy to me but not given till last. After that bus got accident so I could not arrange the loan so he given 30 more days time. Within that period I arranged the loan amount and balance amount. For receiving loan amount he has to put signature in the ROT Office for name transfer process. He agreed earlier but finally he did not. So I could not settle the amount as he did not put signature. Now he is telling that can not return the advance amount 12lakh. What could I do? Kindly

Dear friend,You have not clearly mentioned the possession of bus is to whom with.It is essential to check out the documents u both have entered.You have also chances to file criminal complaint against the achieve.

Q: Unable to attend family court for case what to do now

Did not attend family court notice on 24/8/2017 in coimbatore , notice send by my wife through mutual concent, both are staying in uae, i could not attend to financial issue but wife attended, do not know the result. OS42/2017 HS24/8/2017 P S NO 2840, we are muslim. what will be the next motion, any possibility for counseling and make reunion ?

Dear friend, You have to be very vigilant regarding any legal notice.You have said the petition has filed under mutual consent. Without your signature and consent she alone can't file mutual consent.Any have the suit is posted on 24/8/17 if the summons are duly served to you is reported on that day.You have been called absent and set ex part we.You also have a chance to move the court soon. To cancel the expartee order agaist you. With regards.
