Questions Answered by Advocate T Kalaiselvan

Q: Foreclosure statement applied in the bank issue

I gave a letter to the bank for a foreclosure statement, but till now I am not able to get the letter, can I put any case on the bank

Advocate T Kalaiselvan answered
You first of all send a reminder to the bank about it and demand the same to be furnished immediately. if the bank is reluctant or maintains silence, you can escalate the matter to banking Ombudsman and seek its intervention. if there's no response from them too. then you can file a case before consumer redressal commission for deficiency in service and compensation

Q: Regarding my daughter TC.The school is not proving a TC.

My daughter has studied in cbsc school in namakal district for 1st std in last year. Now I have changed the school.previous school is not providing a TC certificate. They are holding my daughter EMIS No.They are asking us to pay the first term full fees.what I should do?

Advocate T Kalaiselvan answered
When did she leave the school, was it after the completion of last academic year or during the midst of this current academic year? You can issue a legal notice to the school authorities demanding TC as you have shifted to some other place. if they still don't respond you can make a complaint with the district education officer about it before escalating it through legal forum.

Q: Validity of Settlement deed if not signed by settlee

Settlement deed for house property (with condition of life interest) has been registered in sub-registered office. It was signed only by property owner (settler) and NOT SIGNED BY SETTLEE. Is it valid in court of law? Based on not signed by settlee, can it be taken to court and demand for its validity null and void?

Advocate T Kalaiselvan answered
Even if the settlee had not signed the documents at the time of registering the settlement deed, the transfer of property by this mode is considered as legally valid provided the beneficiary is taking possession and transferring all the records to his name subsequently.

My father died and left behind one daughter(me) ,wife and 2 sons.My brothers have now occupied the land and refuse to give a share to me and my mother.According to muslim law what are my rights.can i ask a share of the land?

Advocate T Kalaiselvan answered
As per Muslim law of inheritance you are entitled to half share to that of your brothers. Your mother shall be entitled to 1/6th share out of deceased husband's property if he is reported to have died intestate.
