Questions Answered by Advocate Sistla Rama Krishna

Q: Can one take legal action in case of an undated cheque

He should give me certain amount while we were dividing property. The registration is complete.there is no agreement and only cheque was given.I was given a cheque from a cheque book which was reported to be lost and also the signature doesn't match. The cheque was signed by him in front me and two others. Amount was written but he did not write the date and name "pay to". He has done that with a plan. Can I go to court with these cheques?

Advocate Sistla Rama Krishna answered
Dear Client, You can go for court to ask for amount as he did not pay the amount in dividing the property. The Cheque given by him was also dishonoured due to non matching of signatures. You can file cheating case against him for cheating you. Engage an expert advocate and file criminal case against him for cheating.

Q: What are the chances to get vaction of injection order

In 2014 we have bought one land, which was already selled to some other party in 2006.that other party got injection order and issued notices to me, and ready for construction of house.so iam requesting you to give possible solution to " vacate injection order". What are the chances for it?

Advocate Sistla Rama Krishna answered
Dear Client, Whether have you engaged any advocate. File your answer by projecting your case by placing evidence of your registered documents. Your advocate must argue on injunction petition for getting vacated the injunction order. If injunction order is not vacated, then your advocate must file a petition for status co to keep the property in tact, that is without any construction of anything on the schedule property by opposite till the disposal of the suit, otherwise it will become very difficult for you to demolish, if injunctin order is vacated after the disposal of the case. You must show to the court that you have prima fice case, balance of convenience in your favour. Injunction will be vacated if your advocate argues effectively. Take expert legal advise and expert legal assistance.

Advocate Sistla Rama Krishna answered
Dear Client, What is your sister. Whether she is educated woman or not if so she can do job for self reliance. If she were abused and blamed, then why did she remain with him. Ask her to come to her parents` house. Ask her to put the matter before marriage elders, mediators, well wishers, relatives and parents. File complaints before police authorities. It is not right to stay with a blaming husband. Try to have judicial remedy as soon as possible. Why should she remain with him. Without any respect as wife she cannot live with him.
