Q: Recovery of debt or transfer of ownership

Hi.. I given Rs. 6 lakh to relative on writing stamp paper for the period of 3 year. Amount paid in cash step by step e.g. 5k, 150000,1Lakh,......On stamp paper it is clearly mentioned that if borrower unable to pay debt then they have to transfer the ownership of property. Period already completed 1 year ago. Borrower not ready to extend period or transfer ownership of house. Still they can't given any 1₹. Please suggest me how can i recover my money or transfer the ownership of house of the borrower. Please suggest.

you can either file Money Recovery suit or you can file suit for specific performance of agreement, need to check the documents which you have entered into..Depending upon the clauses in the agreement we can initiate proceeding..first you have to serve a demand Notice, depending upon Notice reply you can decide further line of action

In the cheque bounce case i got convicted. What if i have no capacity to pay 20% of fine to file an appeal as per section 148 of NI Act. What are the consequences if i don't pay the appeal amount?

Q: Can society fund collection be refused when maintenace already done

I am staying on 6th floor of a cooperative housing society and on top is the open terrace. There has been heavy water leakage into my / my neighbour's flat during rainy season making life impossible for us. I made a written request to society in April 2018 to carry out repairs but society sent us a printed circular that they have no funds and they will be collecting 1.5 crores from members. As the monsoon was fast approaching myself together with my next door neighbor carried out repairs to the terrace at our expense. We sent a letter to the society attaching our respective bills and asked the society to give us reimbursement. However, in the meantime society held an EGM and decided to collect funds in instalments from members to install a roof on terraces and carry out other repairs. The society has not replied to our letters and reminders. Can we refuse to pay the repair charges that society is now collecting in instalments from members? Are we legally correct?

Q: Request your advice on how to proceed further with NC

Sir/ Madam, I got married (inter-caste marriage- both are Hindu) in 1989 February. Our daughter born in June 1990. My husband left me & my daughter in Aug. 2004 when she was 14 yrs, studying in 9th. He carried away all my belongings making me ZERO. He carried away original agreements of shop (he purposely bought in his single name) & house (of which he is the first holder & I am the 2nd holder), my gold which was in the locker (locker keys were always with him), FDs, Bank Passbook, Ration Card etc. He filed NC at the Police Station while leaving. Since the time he left, I had to support my daughter for her studies, all her needs & expenses of the family. He is living with a lady. He is not ready to give divorce because he wants the house too. I need your kind advice what should I do to get the gold and house at least. Can I lodge NC now after long years? if so what should I mention? Will filing NC help me any further?
