How much percent can I claim as maintainance from my husband's salary to me and my child of 7 years old living with me ? 498a is running in the court.he was working in a software company.

That totally depends on the salary of the husband. Also, the expenditures have to be calculated and assessed. There is no fixed percentage. There is an entire performa that has to be filled by both the parties and then it would be calculated and rest depends upon the arguments in the court.

U will have rights over movable and immovable properties and properties inherited etc. Plus many claims depending upon the situation. Also it depends whether the divorce is mutual or not and she there have been previous complaints or not.

Q: Married 2 year back and never stayed with now husband want to divorce

I was married 1.5 years back in Arya samaj mandir. Now the boys parents are not agreeing for the marriage and i have never stayed with them and they have sent us a divorce notice. Now can't i stay with him? I don't want to divorce him.

If he marriage was solemnized in arya samaj mandir, then it is a legal one. And if u dnt want to give him a divorce, then no one can force u to do so. The question is whether the marriage has been consummated or not.

To get a divorce, a minimum separation of 1 year is required. Then by mutual consent, it can be dissolved in 6 months from the day of the first motion, I.e, first stage of divorce. But that has to be mutually agreed by both the husband and the wife.

I was working in a pvt company where one of my colleague asked me to provide a friends bank account number as he has to transfer his funds which he would be receive from his friend.I have done the same, but when i and my friend went to the bank to withdraw the money, we found that the amount has been deposited from the company i worked for. I have paid the money to my colleague and asked him 5000/- .now after a year, the company has traced out the transaction and filed a case on my colleagues, me & my friend. But a month earlier, my friend's bank account was hacked and he reported to the cops

The basic question here is whether any fraud was committed by your colleague against the company or not. If there is a fraud, then the account holder would be held accomplice in the crime, even though the amount is a meagre one. And they would be tried as per the law.
