Q: Rented shop for last 40 years demolished without prior notice

We have a rented shop ,property owned by Jain trust was demolished without prior notice 2 days ago .our stock and furniture was inside the stock. They took away everything .we lost the case in court of law 12 years ago .the court given the degree against us to empty and handover possession but they did not took action that time . Please tell me the sections in which the case will be framed against the trustees for demolishing the shop and taking away my stock,furniture and cash kept in shop Does the degree get void given against us by court since the does not took action for last 12 years

it seems that the passing of the decree by the court you did not not preferred the actions available in the law and ths execution was pending in the court which was either not in your knowledge but dispite of the above taking away the stock against the wishes of the jd is an punishable offence in law and action on your part

Q: Wife filed false domestic violence case what action can i take

The in-laws provoked my wife to filed a complaint of domestic violence almost 3 years back in UP. I was harassed at police station and after 10 hours, settled by agreeing the proposal offered by them. after that I was leaving separately that too in a different state. Now, I got the summon from court where I am putting up of Domestic violence whereas I am not in touch demanding money. Is this possible? can anybody harass upto this extent by dragging law for her benefirts

no it seems you are not suitably adviced in the past nobody can forced the party to live with the spouse against his /her wishes..It seems your wife is only interested in harassing you and not for settlement and the remedy is available with you to take the shelter in the law and act accordingly

Q: My friend received a notice from CBI can they involve me as well

hi.. my frnd recived a notice from CBI regarding vyapam spam case.he is a medical student in Delhi's maulana azad medical college.they called him Bhopal for the investigation on 8 of march. he is still there. we don't have any contact with him. he is a top ranked student also he don't have any relation in this case.I think they are trying to make him accused.

if you donot have any contact with him nor you are involved in any of the illegal activities you need not to worry try to contact your friend and if your friend is not involved in any of the wrong activity they should also not worry

Q: Gave money to a baba to get back my gf he did fraud

sir, I had paid a baba 5000rs. to bring my gf back to me as she left me but i wanted to marry her ...he said he will do vashikaran n will bring me her back...now my ques. is if i lodge a complaint against that baba will i also b punishable ?? have i also committed any offence .??? is dere any criminal or civil punishment for ME ???

you can lodge a complaint against the baba for cheating and breach of trustso far as the lodging a complaint against you is concerned baba can not lodge a complainent against you though girl should not lodge any complaint against you,you can protect you by making a good defence and as such there are less chances of your punishment

Q: Does a stay of a foreigner who is on bail considered a legal stay?

A foreigner who has a court case since over 14 years, as he overs staid his expired visa, and he is on bail, does his stay in India considered legal stay? When he try to obtain documents such as DL, they they ask him to provide a proof of valid stay in India such as Visa, while his court case is because his visa expired and his passport is seized by court so no chance to renew the visa, can the court bail order be considered a proof of valid stay in India? as the visa, or what kind of papers he should obtain and from where in order for him to get documentations such as DL ..etc.

Bail orders need to be seen alongwith other documents, needless to say that staying in a country without a valid visa or permission can not be termed as a valid stay ,dispite of the above the things may be braught to the knowledge of the trial court for needfull.
