Q: Can parents disown daughter from ancestral property
Hi I’m happy married with my husband , my parents wants to keep be off the ancestral property ( owner by my grandparents) , not self acquired as I choose to marry the man I loved . Is there anything I can do to get my equal share of the property , please note I have in no ways caused any physical or mental stress or abuse in any way I still respect my parents . The only reason they choose to keep me away is because of my love marriage please suggest
Advocate Sandeep Praveen answered
With regard to ancestral property, women have equal rights as men and you can file a suit for partition before the civil court seeking for your share in the ancestral property. However with regard to the self acquired property of your parents, they are free to dispose the property as per their wish.

Advocate Sandeep Praveen answered
You can file a petition seeking for restitution of conjugal rights before the family court and get an court order in your favour against your husband to perform the conjugal rights i.e. marital duties and to come join you in matrimonial home. Kindly note that even if you get a court order through this process in your favour and your husband disobeys the court order, it will not be possible to execute the court order as it is against fundamental rights and you cannot forcibly make a person to live with you against his own will. A case for conjugal rights is a good option for those who want to reconcile with their partner as there are good chances of reconciliation during the proceedings because of the mediation and intervention of court.
Q: Query regarding case after getting anticipatory bail from the sessions
A false case was filed against me with non bailable offence, i have got my anticipatory bail and got the court order. What is the next procedure? What will happen next after meeting the I/O and giving bond in the police station?
Advocate Sandeep Praveen answered
After giving the bond in the police station, you would be required to co-operate with the investigating officer till completion of investigation until filing of the final report i.e. the chargesheet. If the investigating officer feels there is no sufficient evidence or if the complaint is false then B report may be filed by the police stating the case should hence be closed or if the investigating officer feels there is sufficient material to proceed against you then the chargesheet with all the evidences would be filed before the court and court will issue summons to the accused for conducting the trial of the case.
