Q: Can a plaint be amended by adding one more issue.

court has fixed issues. I want to add one more which is deciding factor and proof lie on part of defendant. How it can be done. No hearing after framing issues.

Q: How to file case under 12(1)(c)

We had filed two cases in NCDRC against builder for non delivery of flats even after 6 yrs delay. One was to be accepted today and the other was filed in August 2015. There were total 5/10 complainants. Justice Ajit Bhairoke, dismissed both and asked us to take approval of Commission under 12(1)(c) of CPA, in view of its 3 bench ruling on 6th September 2016. How to go about. There are over 1000 flats, out of which only 4 have been offered possession. We do not have the list or contact details of other buyers. How can we file application on behalf of all the buyers in a representative capacity.

Hi, Considering the recent developments at NCDRC, the 5/10 consumer complaints against the same builder can be classified as class action suit and can be considered well within the ambit of Sec 12 (1)(c) , therefore its advisable that all your legal representatives meet and decide the further course of action. However, in terms of application for other buyers . I would advise that a public notification should be given to ensure that all the grievanced consumers can together approach the court.
