Q: Filing a consumer case against builders

Hello, I'm in the verge of filing a consumer case against a builder who has delayed the handover for 2 years and for demanding extra amount as late payment cost! They sent arbitration letter but no response on the dates of action. The question is, for filing a case, do we need to initially page a huge sum of amount to the court? Do we have to pay the dispute amount - 4L initially to the court?Building cost - 37 lakh and late payment dispute - 4 lakh.

No. There is absolutely no court fee in case of consumer dispute. Also you don't have to initiate arbitration agreement too. Consumer remedy is an additional remedy and not an alternative remedy. I have filed 4 cases indentical to your facts.

Q: Booked an apartment in guvancherry no possession till date what to do

We have booked an apartment in sep 2012 in guvancherry sriram properties and till date we are not given any possession .The project is delayed more than 3 years now ,we are paying regular EMI to axis bank. Kindly help us to fight for Justice

File a suit for possession in the Civil Court. However required court fees will have to be paid. Consumer complaint can also be preferred. Consumer complaint is cheap and does not require court fees.

Q: misused of cheque by changing the signature legal query

My sister sumbit his kyc document and blank cheque without his sign to suresh for loan after some time that cheque was deposited in my account it was return due signature different. Suresh miss used my cheque by puting his sign on my cheque to slove his problems now the third party told and threaten me to pay the amount or else they will file cas against me and now what can i do sir I already file a complaint in online and what I do with bank and what can I do to relieve from this problem

A case of dishonour of cheque can succeed only when there is a legally enforceable debt. In your case the debt seems to be debated. So even if he pursues a case, if you defend it well, you have a chance of being relieved.

Q: Refund of fees from the self-finance engineering college

sirs, I want to know whether a self-finance engineering college can deduct Rs,50000/- as tution fees from the student who joined & paid entire fees but not attended a single class and subsequently she joined one another self-finance engineering college nearby her town.

Sir,This depends on the terms of pay and the agreement. On equity they cannot do so however exact legal position can be said only after perusing the documents. Your remedy will be a suit for recovery of legal owed money

Q: procedure for name changed---------

 i have a small issue in our land document. before years a land of ours was registered in my mothers name... my mothers name is Ealiyamma in all documents..But she also got a name called as jessy...no documents its just a alias name used at home. Unfortunately the land was registered in the name jessy, i know thats gonna be a problem in future, so now i need to change the name. Can i change the name..? whats the procedure..??
