Q: Bond signed at joining what amount can company recover if i leave

I am central government employee and i work in an ordinance factory. I am probation. The probation period is for 2 years. At the time of joining i was made to sign a surety bond stating that if leave job within 5 years after 2 years of probation then we have to give amount spent on us on training and salary received during the training period. Now i am posted in dehradun and i want to leave the job now. The gazette says that a bond of 1 lac to that effect shall be executed by the probationer at the time of appointment. How much amount can they recover if i leave the company?

Company can recover the amount mentioned or if not mentioned, then a reasonable amount. What is reasonable will depend on facts and circumstances . you can approaxh the court if you think the amount is excessive



Q: Ancestral Property sold no money given to daughter

My greatgarndfather been alloted a shop by L& Do in year 1964.he expired year 1981.In year 1994 property got muted in grandfather name ( How when thers is no will?) although he got reliquesh from his two sisiter.grandfather died year 2005 without any will.My father procured reliquesmnet deed from his 2 sisiter and from 3 childern of 3rd deceased sisiter and sold the property.My father and my single brother got money in white (banking) .I am married can i claim?, Whom to claim?, how much to claim?how to claim?, which is the claim? is his a ancestral property?,how long the case would last?

Since the claim relates to post 2005 while your father was and is still alive, you have a perfect and valid right enforceable in law to claim your share in ancestral property. You can take legal recourse to get your share.



Q: Father Sold Anscetral Property Without Taking Daughter Consent

Dear Sir, My Greatfather had a property which he got after parttion in shop against shop in lahore.Now he died inetstate leaving behind my grandfather and his sisters.My grandfather reliqush the share of is sister by giving them amount and had it mutated in his name.The grandfather also died inetstate leaving behind my father his 3 sister,my brother and me .My brother and father started sitting at the shop and i got married .Now father had procured relinquishment deed from his sister and sold the shop .What i can claim now and from whom .Brother got money in name of possession.

Daughter has equal right as a coparcener after 2005. You can lawfuuly demand your share from your father and court will certainly come to your aid. He can't sell the ancestral property without his daughters consent or without giving her proper share



Q: Re-opening inquiry after detection that vital information

REC dismissed me in 1992 on basis of ex-parte inquiry, without disclosing that impugned LTC claim was never processed - a fact that REC disclosed in May 2014 to CIC. The said LTC claim was mainstay of inquiry with 3 out of 6 charges including some 3 old, settled frivolous charges. Since May 2014, I have been seeking to re-open the inquiry, which REC and Ministry of Power have not agreed to. Can I seek legal recourse successfully. Earlier, I had unsuccessfully been fighting this case at various courts, but not on this ground as I was not even aware of fact of non processing of LTC claim.

You certainly can seek legal recourse but you will have to satisfy the court that you were not aware of the fact of non processing of ltc claim. You can even approach the court to set aside the ex parte enquiry if you can satisfy the court that department did not give opportunity to present your side.

In delhi it is known as khatauni, khasra girdawari. They are land records which contains all the details about the land. Khatauni is the register of all persons cultivating or otherwise occupying land in a village as prescribed according to Delhi Land Revenue Rules. It is a document prepared as part of record-of-right in every estate. It contains entries regarding ownership, cultivation and various rights in land. It is revised every 4 years when it is prepared by Patwari and attested by Revenue officer. Khasra Girdawari is a document, in which the patwari enters the name of owner, name of cultivator, land/khasra number, area, kind of land, cultivated and non cultivated area, source of irrigation, name of crop and its conditions, revenue and rate of revenue, minimum twice in a year.
