Q: Company hasn't paid notice period dues.

So I put in my notice on 15th May, with the notice period being 1 month, but the company forced me to leave on 18th May itself. They have paid me my salary till 18th May, but I want to know if I should be paid till 15th June. And my remaining leaves havn't been encashed either. And it says in the contract: "Your notice period will be 1 month. Either party may terminate the employment by paying the equivalent basic salary for the time period in question, subject to the company’s discretion."

Advocate Riddhi Pratap Bothara answered
Based on the clause, if the company asked you to leave before completion of your 1-month notice period, you may have a claim for notice pay up to 15th June and encashment of earned/eligible leaves as per your employment terms.I can review your employment contract and help assess your legal rights and recovery options.

Q: Heavy 40% deduct on post payment of 5 lakhs

Total plot price: ₹11.4 lakhsI paid a total of ₹5 lakh by cheque (in addition to an earlier token amount receipt) I have payment receipts and bank proof of the cheque payment No registered sale deed has been executed No allotment letter has been given to us My mother never signed any agreement. My mother never went to any court or registration office for execution of an agreement. The seller is saying that because they prepared a draft agreement, they will deduct 35% from the ₹5 lakh paid

Advocate Riddhi Pratap Bothara answered
Based on the facts, the seller generally cannot arbitrarily deduct 35% merely because a draft agreement was prepared, especially when no registered sale deed was executed and your mother never signed any agreement. I can help you assess your legal rights and recover the amount paid based on the receipts, bank records and surrounding documents.
