Questions Answered by Advocate Ranjay Kumar Dubey

Q: Can stay orde be given on the judgement of the ncdrc

I have got ncdrc order in my favour, I got 9lac from forum. Can builder approach supreme Court for stay and to return 9lac from me

Advocate Ranjay Kumar Dubey answered
Dear sir, in the instant case the other side can approach the supreme court of India by filing civil appeal and can seek stay of the order of ncdrc. The order to return the amount of Rs. 9 lac can also be granted by the supreme court, though the same is generally not granted at the admission stage, but after notice stage.

Q: Affidavit submitted to Supreme Court in matter related to Unitech

As per the honorable Supreme Court of India's directive, I need to submit information in the "Claim Submission Portal for Unitech Buyers" for filing claim against Unitech builders. One of the document required is an attested affidavit (in RS 10 stamp paper) stating whether I want a refund or flat possession. I am currently in USA and don't have access to stamp paper. If I submit an affidavit on plain paper attested by Consulate of India, will it me considered valid for this purpose?

Advocate Ranjay Kumar Dubey answered
Dear Sir attestation by consulate of india will not work in supreme court of India. However you can send special power of attorney in favour of a person in india and he can sign and get attested the said affidavit for filing in the supreme court of India. RegardsRanjay Kumar Dubey, advocate
