Q: Wife claim dowry after signing MOU of relinquishment of alimony

Sir I am facing 498A divorce n maintenance. At the time of marriage they paid a dowry of 10 laks in the form of D.D. later i purchased a plot in the name of my plot with my earnings Family court drafted an MOU which contains 1.wife voluntarily agreed for relinqushment of alimony. 2. I have to pay 10 lakhs to two children. 3.either wife or children should not claim a share in self acquired or ancestral property. 4.must close all the cases and non of us should prosecute each other in any court or law. My question is 1. Can she claim for return of dowry amount after signing the MOU? 2. Can I claim the plot on my name after signing the MOU?

your MOU is a part of court record.In lieu of said MOU,the matter is settled.In terms of this MOU no one can violate the terms.If any one violates,it is a perjury i.e misleading the court.She cannot ask for return of money nor she can file any other type of litigation/case.Still you want more information, please contact me



Q: What is the fee for filing suit for injunction in property matter

We are Hindus having immovable property in A.P.My brother claiming right over my share and encroached it. I want file injunction suit against him. The market value of the said property is Rs. 30 lakh. Let me know how much court fee shall be paid for this ?

since you are in joint possession,you should file the suit for family partition,wherein the court fee is rs 200/-.After decree of the suit, you should the court fee of your share according to your market value



Q: Received notice by MRO mentioning the land belongs to the government

My father purchased land in a village on his name and some on my name in 1991-1992 and got it registered a total of 18 acers . from then we are in absolute possession and enjoyment till date. Invested huge amounts in developing the land by constructing check dam(land is low level area) and filled with earth and planted many trees. Also paid land tax. have water bore with electrical connection. Now got a notice from MRO, saying, the land we purchased have a government land of 5 acers extent and placed a notice board in my land. Please suggest.

You can approach the high court and file a writ petition as the govt may evict your father from the property without following the due process of l;aw.You have not specified wetter your vendor is having title to sell the property or not



Q: If a Property is being gifted by half brother , will it be valid

My fathers first wife died and my father divided land into two parts one for first wife son nd me. And he gifteded also. Now i am absolute owner of that land or not and if I construct house on that land will I face any problem and from past 15 years we are living on that land area by construction small hut

any immovable property valued more than rs 99/- must be registered under transfer of property act.You did not specified whether your father executed any such gift deed or not. Though it was not registered,your [possession of more than 12 years will have a right and interest over the said property by virtue of adverse [possession.No one can disturb you legally.
