Q: Money transfer app not providing proof of investigation for hacking

Hi, So my online money transfer account was hacked on 31st of July. The hackers refunded all the money which I transferred from my other account account to my current account. The hackers were able to access my both accounts and refund the money back to my clients. I requested the platform to investigate the case and they came up with the response that "We've reviewed your unauthorised activity case, and determined that there was no unauthorised use of your account.". I had requested the proof of Investigation from them and they claimed that I need a lawyer who can send a legal request to get the proof of Investigation. Please Help me with the issue. The amount was about 1 Lac Rupees in the account. I also have the IP Address Activity log from my Email Account which points that IP Address of the Attackers was from Canada. Thank You, Please respond to me as soon as possible.

Advocate Rajesh Nedumprom answered
Hi aspirant, From the nature of your query, it seems that you might be a starter in the legal field or a law student. ANY HOW, Just understand that apart from Anticipatory bail, there are two types of bail in India .One, Regular Bail (S 437 or 439 Cr PC) and the Second is Statutory Bail (S167(2) of CrpC). The first one can be filed before completion of the said period of 60 or 90 days. However, the Second type is entitled only if the Prosecution fails to furnish Charge Sheet with in a period of 60 days in Non-cognizable Offences and 90 days in Cognizable Offences.I hope, it is crystal clear to you and you may be able to provide a good advise to your Client/Friend.Regards, Adv RAJESH NEDUMPROM

Q: Is it an offence to take photograph of a woman without her consent

if a man take photography of woman without her consent and also she warned him to withdraw from that...is it an offence, penalty?

Advocate Rajesh Nedumprom answered
Hi, No doubt that photography of woman without her consent is a serious offence and if she warned him to withdraw from that , then it becomes further more grievous offence which attracts severe punishments by virtue of Indian Penal Code and sometimes attracts IT Act also. If any complaint lodged by any victim against you in such events, it is better to get advise at the earliest. If you need further more clarification on the subject, please feel free to revert back to me. Regards, RAJESH NEDUMPROM,Adv

Q: How to seek protection for family without being bullied by the media

A friend in India has a criminal case charged by Kerala state however the media has been deeply engaged in openly debating about the case in the new hour without facts. This has created a very difficult environment for the family of the accused to live infringing on their right to live. What are the option for that family to seek protection to continue with their life without being bullied by the media, then public.

Advocate Rajesh Nedumprom answered
Hi , Apart from other states of India, discussions on TV Channels are to high in Kerala and the reason behind it is well understood for all !!. So far there were many such unhealthy discussions were "ON" for many days continuously even on small incidents or cases,no victims raised their voice Legally (R) Legally on these serious issues which if basically violation of the existing provisions of law. Any how, it too nice to see such a query and obviously, you can take up the issue by way of litigation. If need more clarification, please feel free to revert back to me.
