Q: What are the grounds on which I can file for divorce

Me & my wife got married on 24th Jan 2017. After some complications, we are living separately from 13th May 2017. I filed RCR under section 9 of HMA but didnt attend any dates of court. She moved application for interim maintenance on 16/08/2017 & got maintenance as 6k per month. When she was living with me from 24th Jan 2017 to 13th May 2017, she started abusive words to me & my parents. She even tried to suicide by knife & tried to hit me by knife. She started screaming at my home without any valid reason just like I am beating her. What is procedure to file divorce in this condition ?

Advocate Pranali Wankar answered
There are various grounds for divorce and various types of divorce so you have been getting mentally harrassed hence it is a ground of divorce or you may go to a marriage counselor and see you can settle things on your own or come down to the conclusion on separation and go for divorce by mutual consent.

Q: Procedure to fight 420 case filed by company for cheating.

HI I was working for an organization at a Sr position. The company was a start up and they were into business for last three years. Since it was already three years we had to expand the business i suggested to company to also take up consultancy however my founder was not very convinced by the idea. so i suggested if i do consultancy on my own alongside wid my work and if i get any business i can offer you a 10% consultancy as i may need office support to implement the work and we agreed. However the moment I got my first consultancy order, the founder stared repenting for the decision of not agreeing to my offer and she could not digest the fact that consultancy makes good money. My first consultancy order was for 10lakhs and as promised i gave her 1lakh as 10% commission. But she still threw me out of the job and filed a 420 case against me. Police had arrested me and post 14 days i got my bail the case is still pending in the lower court how do i deal with this...please help

Advocate Pranali Wankar answered
HiSince you are already out on bail, you can keep a check on the matter / trial and you need to gather the proofs or agreements signed between you and the founder of the company with regards to the consultancy. Another thing you can do is you can file a case against your employer

Q: what can be done if accident claim party does not come for hearing ?

A car accident happened in between my and another people car. No human injury happened. he filed FIR against me. case submitted in court. now that party never comes to hearing. what should I do and what will happen to this case if that party will not come to court. I deposited 15000/- in court as per judge orders.

Advocate Pranali Wankar answered
If the party doesn't want to come to the court and is interested in settling the matter outside the court then you can go for this option and can withdraw the case or there will be. An ex parte order by the court on its own motion you do not have to do anything.

First of all you will have to file a complaint with the police if there is any fraudulent transactions taken place and of that concerns you then you may raise and RTI application and find out about the same. bank details are a very confidential thing so if you have suffered any damage and hence you are claiming that then only the authorities will help you if it is not a genuine case then you may be in fix.
