Q: My Name Is Mohan Singh Luving In Delhi

My wife is not living with me for the last 2 years. I already send legal notice but no reply. So i want to file case of divorce now but want to councling first. What to do now.

Q: Delay in final court judgement despite the respondent Ex parte

Petition was filed in 2015. After 3-4 appearance, respondent did not appear in the court. Hence, judge passed ex-parte order in October 2018. After submission of affidavits from witnesses, final argument was heard by judge in February 2019 and directed for final order on 10th April 2019. Meanwhile that judge was transferred and new judge asked that he needs time to go through my case and gave next date in June. When I appeared in June, he gave another date in August for argument. He deferred my case to next date in October without citing any specific reason. I am aggrieved, what to do now.

Due to the extreme backlog of cases the judges are not having time. You dont need to worry about the same file the written submission in this date along with an application to expediate the proceedings. And let the judge pass the order in the application before that only he will pronounce your judgement. Any further query plz call

Q: Dowry death which also resulted in death of unborn child

In my case, the victim was killed by her in-laws for dowry. She was 7 months pregnant at that time. I want to know what all charges and sections of IPC can be filed against her. Also, I want to know what all sections can be included in the FIR.

Well FIR has to be registered under section 304b, 316, 498a, 406, 34 of IPC . These are sections accordingTo your query it will depend on the complaint apart from these what all sections can be there in the FIR . So primarily it depends upon complaint and then the investigation being carried by the IO.For any other query plz call.

Q: Lodging an FIR against husband & in laws for dowry & stridhan in CAW

I had put my complaint against my husband & in laws in CAW cell this year in june... since then we have been given 7-10 dates for mediation but my in laws have refused to return / posses my jewellery & belongings... now i uv closed my mediation sessions but my husband has filled divorce case against me... will now FIR in 498a be lodged against him??? Can they get bail easily???

Yes the FIR will be lodged against all the accused person. Nowadays bail is not that issue in dowry harassment it is only issue when accused person failed to join investigation. Apart from CAW cell you can file other cases against ypur husband and his fanily members as well as after registration of FIR you can insist the IO to file application for search and seizure of your article along with bank lockers
