Questions Answered by Advocate Navya Singh

Q: Multiple credit cards issued fraudently using my name & identity

Few months back, i came to know about 3 credit cards issued fraudently using my name, identity and other documents from 3 different banks (HSBC, AMEX, SBI). Currently there are 3.5 lacs outstanding showing up in my CIBIL report. I had lodged complaint with all the abovementioned banks and also lodged complaint via email to respective Police authorities in Noida. Now, i am in constant touch with the fraud investigation teams of these banksand they are asking me to 1) lodge an FIR in police station or 2) file online complaint in Cyber Reporting Portal of Govt. of India. How should i proceed.

Advocate Navya Singh answered
You should file cyber complaint in the cyber portal and also simultaneously you habe legal recourse to file a complaint under the Information Technology Act before adjudicating officer under section 43 and 43A for damaging your data and also identity theft if someone is using your details and posing themselves as you.
