Q: Daughter in law harassing me and my son

I m a hindu. My daughter in law is harrassing me and my son also from many years. She never behaves properly with me. From last one month she is not even cooking food for me and my son. We have already trabsfered our house on her name. Now i want to ask how can i get papers back frm her and also what action can i take against her?

You will approach the court for your sale deed under the welfare and maintainace of parent and senior citizens act. Court have full power to cancel the sale deed if any or also direct her to return the original paper to you. You can also file violence complaint against her in the court. If your son desired then he will file divorce petition. In the latest judgement of supreme court of India held that not cooking food for in laws is similar to cruelty.

अगर पेटिशन में बच्चे की कस्टडी के बारे में कुछ बी ने नशन नही ह तो आप बच्चे की कस्टडी के लिए अलग से पेटिशन डाल सकते है, और डाइवोर्स आपसी सहमति से ले सकते है। पर अगर आप D.V. petition या maintainance ki अलग से पेटिशन डालना चाहते ह तो आपको डिवोर्स पेटिशन वापस लेनी पड़ेगी।



Q: Husband and in laws repeatedly abusive, want divorce and child custody

Hi, I got engaged in 2007. My husband was out of India during the courtship n was really loving and caring. We got married after 6 months.It was an arranged marriage. After 2-3 months of marriage problem started. My husbands behaviour was rude and physically abusive. In-laws made the situation worse. After 1 yr my daughter was born. By this time my relationships with in-laws & husband became very bad. My husband started hitting me really badly and I had to report in police. I dint file FIR because in police station my husband apologised. But I thought of taking divorce and lived with my parents for an year. He made no contacts and I made first email and asked for divorce. He denied Divorce. After 6 months my husband approached me and said sorry and told me he want me back. for my kids future I agreed.Life was fine for a year.He was not physically abusive.Now his behaviour is again changed.I want to divorce him but want kid custody. Plz help.

You can file two separate cases. One for the divorce and second for custudy of child. You can also file a case for maintainance also. If in laws or husband beat you then you can file complaint under domestic violence act.
