Q: Wife torched me and she abused me ..i can't live with her

I m handicapped person my wife torched me everetime i fear that she kills me or depressed me that i admit suicide..plz help how i handle this situation..i can't live with her

Advocate Mishika Singh answered
You can file for divorce on the ground of cruelty. In the meanwhile, you can also start living separately (if you have the means to) in order to evade the situation. Ask for an interim relief on these grounds when you file for divorce.

Q: rejoinder reply by the plaintiff herself/himself format

1. What date rejoinder write and sign on submision at court2. General format written by the plaintiff to submit in the court3. How to mention 65b , evidence act's acceptance in annexure2. How lenghty the prayers should be?

Advocate Mishika Singh answered
Time for filing rejoinder is usually decided by the court when notice is issued. Please check previous orders for the same. Format can be the same as the pleading. However, it is always better to file a rejoinder only when something that is not said in the pleading needs to be said/something raised in the WS needs to be answered. The prayer is already included in the main pleading.

Q: Tenant rights, standard rents in Delhi

I am staying at as a PG in Delhi. The landlord has given the property to someone else now who will manage the PG for the upcoming time. Now, this new man has set his own T&Cs and fixed a new rent which is 25000. Earlier, I was paying 16000 per month. Now, this is a 9000 increase which he says includes food, laundry, wifi and some library access. He is saying if you want to continue you will have to pay 25000. I mean, for once I can say that okay I will pay 20,000 that is 4k extra for food but for some basic facilities such as laundry and wifi which I don't need he is charging me hefty. When I asked him that out of this 25k how much will you be charging for the accomodation, he didn't disclose. This is tbe height of extorting students. Also, rn I can't afford paid lawyers. As a tenant, what are my rights? It would be great if I can be enlightened plus what are the standards of fixing the rent under sec6&8, Delhi Rent Control Act?

Advocate Mishika Singh answered
When you say the landlord has given the property, do you mean he has sold it? Depending on what rights your landlord has transferred, the person in question may not even be entitled to demanding the rent if he is not the legal owner of the property (unless the facts are otherwise).

Q: CHILD CUSTODY- INTERIM ORDER BY THE COURT

my sister is divorcing her husband and the court has given interim custody to her and visitation rights to her husband. he has mental heath issues that make her skeptical of her child's safety when the child is with him, the child is 8 years old. what can she do?

Advocate Mishika Singh answered
She can file an application stating these facts in order to get the interim order modified. In many cases, the court directs the father to meet within court premises, in order to ensure safety. that request could also be made.

So i knw it is legal for both of us to book an hotel room wr both are 18+ bt still this is our first time so we are scared. Is is oyo rooms safe for unmarried couples? What if someone do harrasments with us like police ? Pls suggest if they forcefully persuade us to go police station etc. How to keep ourself safe and secure? We will show our identity proof also

Advocate Mishika Singh answered
Oyo couple rooms are safe. You can go ahead with it.You will have to submits your government photo IDs in any case when you check in. Chances of someone harassing you or forcing you to go to the police station are negligible. However, it is well within your rights to refuse to go in such a case.
