Q: Nursing home infrastructure requirements as per law

I have a nursing home established in the year 1986. I got a letter today from the disaster management department with a deadline of 24 hrs. They are accusing that the road in front doesn't have sufficient space to accommodate 15 fire trucks. Mine is a level 1 nursing home. I have complied with the internal requirements of fire safety. Do I have a remedy as I can't increase the road width.

Dear Sir/ Madam,Do you have a NOC from the Fire Department. If yes, then you can inform the National Disaster Management Authority about the same and can also send them a copy, if they so desire. If no, then please pay a visit to NDMA to understand their requirements. Regards

Q: Maintenance in case of domestic voilence

I have been in an abusive relationship for 4 years. My husband yells and compels fights and aggressiveness. He would beat me, but I haven't filled any complaint to avoid differences. He is in central govt. He has been cursing me and my family ever since we got married. It has come into my knowledge that he has been recording my responses and my calls that I have made to him. He has very cleverly been able to record them in a way that it seems that I am cursing his family etc. Now, since December I have moved out with my 2.5-year-old daughter. Been to a counsellor etc, he has been diagnosed with strong depression. However, now he is threatening me that he will put all sort of litigation on me, to escape any maintenance against me or our daughter. How can I save myself and how can I still ask for the maintenance

Dear Mam,In this circumstance , you can file two cases to start with. one under Domestic Violence Act and other under section 125 of Cr.P.C. Please note that getting maintenance for yourself and your daughter is your right.

Q: Action as gynecologist's negligence causes baby's clavicle fracture

Hello, I want to filed a case and FIR against gynecologist. My daughter born in dec 2017 by normal delivery but after the delivery of my daughter, she was diagnosed with Clavicle fracture in her right shoulder. Since then she is not moving her right arm & hand properly and diganosed with brachial plexus. Even the doctor treated me very badly and unprofessionally.

Q: Inappropriate flat condition and harassment by builder

 We booked our flat in Noida sector 4 in 2016 but builder told us last week that your flat has been cancelled by our company (without any reason ) and saying to refund our payment that is only 50% of the total money deposited by us. They told us in starting that u have to pay only 25% of the purchasing amount (22lac) and after that u have to pay loan emi's from Gic (general insurance corporation ) in Noida and promised us to give possession by the ending month December 2016 when he was dealing with us but when he made agreement he wrote possession date from December to May with grace period of 3 months but flat condition is still horrible and now he is saying us to take refund of 2.5 lac and 2.5 lac has been deducted from ur money

Dear Sir,Based on the agreement signed by you, you can approach the consumer court for the redressal of issues. Does your agreement also cover the specifications of the flat. If yes, and the specifications do not match with what is written in the agreement, you can go to Consumer Court. Please show your documents to a lawyer before going to the Court and take his or her advise.
