Q: Can the fir be quashed if filled under POC

a person filled an F.I.R against me under the prevention of corruption act and has video evidence against me.Now we want to do out oof court settlement.is the same possible. If so then how can we get the Fir quashed before the charge sheet is filed in the court of law ?

Q: Process of withdrawing a Rape Case currently under trial

A friend of mine filed rape case which is under trial, she is very depressed and has been abondoned by family and husband. She had her 2 kids with her and now is unable to bare the pressure of the case...She has developed suicidal tendencies.We want her to withdraw the case and start the life again. Is it possible to do so

There is no process as such provided in any of statute to withdraw the complaint during trail in rape cases..............

Q: Boyfriend broke up with me and had physical relation as well

My boyfriend n I had a breakup. He physically touched my private parts n breast n sexual area n kissed me when we were in relationship with my consent. I want support n want to file a case against him, as we were in a commited relationship n now we had a breakup. What should I do?

Q: False ATR by police will magistrate give the judgment on that basis

I have registered a case in court for, 156 (3) crpc as police not registered my FIR. Court ordered the police to submit ATR. Police investigated the case but submitted false ATR in the court. My question is ... Will magistrate give the judgment on the basis of ATR or magistrate will give a chance to me to ask enquire about the points written in ATR. Will there be cross questioning about the matter with police and me infront of magistrate on next hearing ? Or magistrate simply dipossed the case after seeing the ATR without asking anything to me.?

No it is not like as you are thinking .Atr is called by the magistrate to know the status of preliminary inquiry if any conducted by the police official in the matter in hand but it is not the sole criteria or basis to decide your application. On the next date of hearing you will be having every opportunity to argue your case and show the contradiction of atr.
