Q: Can succession certificate is valid for immovable property

My father has a joint ownership property with my mother as now my mother has been deceased without any will he wants to convert it into single ownership Can succession certificate is valid to declare the legal heirs for that immovable property so it can be sold out later

My Father a Retired Air Force Officer wants to transfer his flat owned in Sector 21, Noida ( AFNHB to my name. Does he execute a gift deed or would the entire stamp duty have to be paid. Would request for advice and inputs

your father can transfer his owned property by execute a gift deed , yes you have to pay stamp duty according to sector rate and secondly your father can also execute a will deed after his death,you don't have to pay any stamp duty

Father expired. Mother and 3 sons are alive. Want to get partition done easily. One of the brother is not agreeing. What can we do to resolve the matter easily?

Q: Property and second lady matter

My father(age68)passed away last month. He was not staying with us from last 7 years and was staying with a lady (age 49)without any divorce. Their address was not known to us in later years we were in touch with our father on phone as he was suffering from diabetes from last 25 years and we use to worry for him. Form 4th day since our father died we found a suspicious behaviour of that lady. Today I came to know that lady had taken out around 3 lacs amount after his death through his ATM card . Only me and my elder sister were joint holder. we need guidance regarding succession certificate.

That lady who had widraw 3 lacks ruppess after your father death you can do criminal procedding against that lady.In case of sucession you have legally entitle for money of your father .In case of property you can also apply for decliration in the court
