Q: Fees for Succession Certificate

There is no dispute between the legal heirs; all papers are in place; and we need succession for two flats in Mumbai. What will be government fees and lawyer fees for the same?

there is a territorial jurisdiction for filing petition in court. it depends on where the property is situated in Mumbai area.court fee is depend upon valuation of the property and without studying the papers can't tell the fees.

Q: Legal heirship of joint property owner confusion related query

I'm currently looking for buying flat in Mumbai, owners husband has died in USA and She has transferred society share certificate under her name. Property was originally under husband wife joint ownership. She has a married daughter and son, however property succession was not done. Now that we have to do sales deed, does any legal heirship is belongs to son and daughter? Or we can directly make sales deed under sole ownership for her?

in the absence of Will the property originally owned by husband will go to his widow n children, if children are not interested in the property then they can release their claim by executing release deed. then the widow will become absolute owner of the property and can sell it.

it means new case is filed n it's for admission before the court.if it is admitted then court will direct the department to issue notices against opponents n if it's not admitted..case will be disposed off.

आमच्या शेतावर इतर हक्कातील एका व्यक्तीने जबरदस्तीने ताबा टाकला आहे. कायदेशीर बघता त्याचा त्या शेतावर काही अधिकार नाही. याच शेतावर मांगे कोर्टात आम्ही केस जिंकलो आहे त्याला कोर्टाने नो एपिली दिली आहे. इतर आखात फक्त विहिरीवर त्याचा अधिकार दिसत आहे. यावर मला लीगल कन्सल्टेशन हवे आहे.

कोर्ट केस चे कागदपत्रे आणि जमिनीची कागदपत्र पाहून योग्य सल्ला देणं शक्य होईल..कोर्ट केस जर त्याच व्यक्तीच्या विरोधात जिंकली असेल तर contempt of court order ची फाईल होऊ शकते आणि जर इतर व्यक्ती कब्जा करत असेल तर तुम्हाला तुमचा हक्क सिद्ध करण्यासाठी seperate suit file होईल

plz check whether it's suit or interim application..if it's interim application n the same is disposed of them not necessary main suit is also disposed of but if the main suit is disposed of then ..yes it means your case is over n uncontested means opposite party is not appearing in court n suit or Application is not opposed by them.. therefore it is disposed of uncontested..
