If its a self acquired property, then you can execute a Will or make a gift Deed. If its ancestral property, then you have to challenge his share in court and file for partition as it is his birth right. you can file a case to divide the property to all coparceners.

Put property on alert, In Sub-Registrar Office, Loni, File a complaint application, Mention property details, Inform that dispute exists. File FIR in Loni Police Station, 420 IPC, 406 IPC and 467/468 IPC (if forgery involved).

A Deceased Father Rhas registered Will in favour of 3 sons out of 5 children for a plot in GK, Delhi, 2 are daughters. One of daughter is no more, having 2 children. In Delhi, a registered relinquishment deed is usually required even with a Will. In Delhi, a registered relinquishment deed is usually required even with a Will. Key requirements: Registered Will, Death certificates (father and deceased daughter), Surviving Member Certificate, ID/address proof of executants, Registered relinquishment deed before Delhi Sub-Registrar, Two witnesses, POA if anyone is abroad. Probate of the Will is strongly recommended in Delhi (often required by authorities). Proper execution avoids future disputes, sale objections, and bank loan issues. Register relinquishment deed (from daughter and grandchildren). Apply for mutation in sons’ names.

I need clarification on a civil suit. My father won a declaration case, and the appeal filed by the plaintiffs was dismissed for default. They have now filed for restoration, but we haven’t received any notice yet, and there is no stay. Due to medical issues, my father wants to transfer the property to my mother. Will this create a negative impression if the appeal is restored? Is it advisable to proceed? We have not received any summons for restoration. Can we transfer the property to mother?

Legally, the decree is operative and property transfer is technically permissible now. However, if the appeal is later restored, the transfer can create a negative impression and will be subject to the final outcome of the appeal. The transfer will not be void, but it won’t protect the property if the appeal ultimately succeeds. Not advisable to transfer during the pendency of restoration unless unavoidable. Wait until restoration is decided (best). Execute a Will instead of transferring now. Seek court permission citing medical reasons. If transferring, clearly disclose pending litigation and state it is subject to appeal outcome.
