Questions Answered by Advocate Jubina Begum

Q: Fathers self acquired property dispute

My fathers (he passed away now ) self acquired property (10bigha agricultural land) and it’s in my mother and sisters name . So, my uncle and aunties are asking a part of it (6 bigha) bcz according to them it’s not self acquired by my father but it was our grandfathers land and he named it in my fathers name . So they are trying to illegally possess it what should we do .

Advocate Jubina Begum answered
if they possessed the land you can take legal action against them. As the land is in the name of your sister and mother and also it was the self acquired property of your father your uncle and aunties have no right over them. Don't worry they will not get the property.

Q: Essential points which have to mark at the time of devorce.

Will the court give money receipt instantly when a husband gives alimony in the form of check at the time of mutual devorce as single instalment to his wife ? Will the court issue the devorce certificate? Is it necessary to make an agreement at the time of devorce where there has not any children ? Can a contextual devorce case convert into mutual devorce case ?

Advocate Jubina Begum answered
At first you have to know the whole procedure of a divorce. No final divorce order will declare till the installment of alimony. secondly no need of any agreement. You can make agreement as per your wish. Thirdly contractual divorce is not valid. For obtaining of divorce you should have to file divorce petition before the concern court.
