kindly give information how to process for divorce

Advocate Jenal Bharat Busa answered
there r 2 kinds of divorce, mutual and contested. if your partner is ready for divorce then u both can proceed mutually. which is very simple and easier. in case if your partner is not ready for divorce then you need to file for contested divorce taking some grounds for which you wish to take a divorce. but it is time consuming and lengthy process.

Hi, nI got a legal notice from my wife after 3 months of marriage imposing all false allegations. so I denied everything iny reply notice and filed a RCR stating that my wife is doing all this activity because of her uncle. Now my wifes lawyer said to my lawyer that lets end this mutually. The court ordered for mediation and in mediation first session I'm interested to live with her and since they are asking for divorce I'm ready to give . but my wife is demanding for one time settlement in mediation and I disagreed to pay . so the mediator has requested the judge for another mediation since I denied for one time settlement. what to say in next session to avoid paying one time settlement to her.

Advocate Jenal Bharat Busa answered
you can inform the judge that it's not your fault and you wish to stay with her and you haven't done anything wrong to be made liable to pay anything. infact you can stay firm on your stand. if she is desperate for a divorce she will agree for divorce without any payment. if she is working then she is not eligible to receive any maintenance from you either, hence she is imposing on a one time settlement. say that u want to live with her and if she wants divorce then she has to give u settlement money for imposing a divorce tag on you.

why do u want to stay with your husband if you had agreed for divorce earlier. in case, if your feelings are genuine then better return the money n ask your husband that u don't want money n u wish to stay with him. n ask the judge to send the matter for mediation. if u r doing this for more money then you can withdraw the consent for mutual Divorce.i am available online. you can call me for further detailsadv jenal busa
