Advocate Jaideep Patkar answered
Before we proceed to analyse ur rights in the dispute property, we need to know whether ur name has been recorded in the revenue records of the property...? Or whether at any point of time your share has been admitted by the other co-parceners or co-owners? Irrespective of the answers to the above , if u need to assert rights on the property, u need to Claim share in the property by issuing legal notice. If notice is not complied, suit for declaration, injunction and partition should be filed in the court of competent jurisdiction
