Q: Father passed away without a Will

My father passed away without a Will. My father bought a commercial property 40 years ago on his name and doing business in partnership with my uncle. now uncle claiming ownership in that property. we are Hindu family. also my step sister's son also claiming rights on that property after death of my sister. My mother is alive without any income for living.Please advice how to sort this issue.

if there is no Will for self gain property don't worry ,you may file civil suit and succession application for you are legal heirs of your father property . court may decide your share in your father property.

Use bechne k liye hmne ek 100rupees ke stamp pe agreement kiya tha jisme usne hmare sath dhokebaazi kiya Hai ..usne agreement Marathi language m likhwaya tha aur Usme usne yeh mention kiya ki Usko registery bhi hm krwa k dege ND sare tax etc Clare krke dege aur date 24/6/2019 se 24/7/2019 but usse Hmari yeh baat nhi hui thi... Aur hme ye pata nhi tha ek glti se agreement sign Ho gya aur usse hmne 50thousend amount le liya but ab Woh baki amount bhi nhi de raha h aur hm use kahe rhe h apne paise wps le le toh kaheta h notice bheja h tmhe.. Aur hme abhi tk koi notice nhi aya ab hm us plot ko kisi aur bechna chahte h to aap help kariye Kaise hm solve kre yeh problem ..

आप ने स्टम्प रजीस्टर कर दिया हैं या नोटरी ? अगर दोनो नहीं तो . आप के पास दो आपशन हैं १) agreement नही हुवा ऐसे बता सकते. २) आप agreement मान्य कर उसे वह agreement cancel करने के लिऐ लिगल नोटीस भेज सकते हैं. जादा

Q: Conversion of regular recovery suit into summary recovery suit

I have already filed a regular civil recovery case om 04/09/2018..1st date after filing is given 18 sep.2018.. Now today i came to know that instead of filing regular civil suit , summary recovery suit is far better Option also it runs speedy as well..now can i give application to court that i want to convert my regular civil suit to summary suit as i didnt have knowledge before filing this civil suit as a regular..i didnt get legal advice what i came to know now.. Can court allow me to transfer my RCS to summary recovery suit and that will run before senior division court as per CPC rule..pls reply..i m very much frustrated after came to know this

you just witdraw the regular civil suit with demand court fee stmap refund and after you may file summary suit or you may also givin the application to regular civil sut to convert as summary sut but yo have less change to convert .

if your father property is ancentral you may file partion suit in civil court .if your father aquire such property his self income you did not have no right but another remedy is available for you but its own risk

Q: Can I file for mutual divorce when my husband also wants to stay away

Can you pls guide me what can i do, my husband is not staying with me, infact I have 2 daughter, I,m looking after them, I have one letter of my husband in that he had wrote that he dont want to stay with us and don't want to stay with us.so can i file for mutual petiton

no you cantbut you can file divorce petition on ground of dissertation from more tan 2 years . your husband letter is very good reason & proof for you . court definitely given you divorce within few month from filing petition
