Q: How to get divorce if both the parties are willing to get divorce

If divorce is taking time, there is any other way like doing registered notary on stamp paper, having details like both the parties (husband and wife) are not willing to live together and both are free in there future ahead. If they like to do second marriage or so on.

You both have option to file mutual petiton for dive and may took 8-9 months for granting divorce.That is legal and reisttered notary on stamp papers etc are no way help you in future. Approaching court is the oly option.



Q: Can i retain custodial rights of children if i remarry?

I am hindu and have two sons 4 and 8 years living with me and I have custodial rights while father has visiting rights. If I want to remarry can I retain my custodial rights and till what age of the kids? I am the solely responsible for raising them and financially supporting them since their birth until now and receive no financial support from father ever since we married and even after the divorce I have no financial support from their father.

You being a natural guardain, you have right to have custody of children till they attain seven years, If the child completes xeven years, it is left to the child to decide with whom he/she wants to leave.
