Since the pawnbroker has refused by saying “time out” and the police sent you back, you should return to the police station and submit a written complaint clearly mentioning that you already approached the pawnbroker and he denied responsibility, and request them to register an FIR; if the police still do not act, you can escalate the matter to the Superintendent of Police (SP) or file a complaint through your state’s online police grievance portal, while keeping all available proof such as the pawn receipt, messages, and shop details.

Q: Legal heir certificate versus family certificate

We r a 7 member family. Having procured family member certificate. How to get single legal heir certificate to claim property inheritance n bank locker access. Other 6 members are ready to tranfer in my name. Please guide

Since there are seven legal heirs, a single legal heir certificate cannot be issued, even if the other six members are willing to transfer their rights to you. The correct legal method is for the other six heirs to execute a Registered Release/Relinquishment Deed in your favour at the Sub-Registrar Office, using the legal heir certificate, death certificate, ID proofs, and property/bank documents; after registration, you become the absolute owner for property mutation, inheritance, and bank locker access. If the bank still insists, you may need to apply for a Succession Certificate from the civil court to operate the locker or withdraw funds.

Q: Preliminary investigation by police before closing case

When a complaint is submitted to police dept, during preliminary investigation stage -1. is it mandatory for a police officer to collect evidence and preserve it before closing the case? 2.under what circumstances can the investigating officer send police notice in Instagram?Based on wat factors can he decide if a case is false or proceed to register FIR for full investigation? Say for example a theft is reported, is the investigating officer supposed to collect evidence mandatorily ?

Police must do a basic inquiry and collect initial evidence before closing any case. Notices through Instagram are used only if normal contact methods fail. If facts show a cognizable offence like theft, they must register an FIR and investigate further instead of closing the case as false without proper verification
