Q: False allegations of sexual assault made by a female colleague

Hello ..I want an advice regarding false sexual assault charge made by a female doctor on male doctor during their nyt shift. Now sexual harrasment committee is going on..what should the boy do? All allegations r false..but how to prove it? Plz guide us

first of all; both of you should be medical examine by the doctor and if the allegations are false then during the medical, it could not be prove that the sexual intercourse was gone between both of you & you shall be acquitted form the case. After that you have remedy to file a civil suit against that her for malicious prosecution.



Q: Can wife ask for maintenance if husband is earning more money

what is the law for ladies who are working and have no family support and are in a totally private job. 2 - if husband is getting one lac or above and wife is earning only 26 thousand without any support, she has to pay house rent, and mess charges, electricity charges,etc - is the lady entitled to any thing?

yes, wife is entitled to received maintenance from the income of her husband; even she is doing job. it is her right to maintain equal economic status as her husband. There is two remedies available with the wife to file a petition under Section 125 Code of Criminal Procedure or application under Section 24 of the Hindu Marriage Act, for maintenance.



Q: Want to file for mutual divorce contested already pending in HC

My contested divorce dismissed by sessions court and contested divorce is pending in high court . Now our compromise has been done and we want to file divorce under mutual consent. can i file it in sessions court or not ? (2) there is any procedure so that high court can direct sessions court to file mutual divorce in sessions court. i want to add one thing another that i do not want to withdraw contested divorce first because by chance other party may break their promise then i have no other option to file divorce anywhere.

you have two options, first and the best is that you can be placed on record your compromise in the petition pending before the Hon`ble High court and grant mutual decree of divorce in that petition, 2nd, file a fresh petition before learned court of District Judge and grant decree of mutual divorce & there is no need to withdraw the petition pending before Hon`ble High Court.



Q: Lady blackmailing to marry her otherwise will file false rape case

My brother had a affair wid a lady and that was divorcee but she did told him that she is divorce. she was fighting for her divorcee after 6 monther of affair wid my bro she told that she is married then my brother denied to get marry to her. Now she has successfully taken her divorce and want to marry to brother at any cost. She was saying get marry to her otherwise she fire lodge A FIR 376 AGAIÑT HIM.please suggest us what to do as she was blackmailing us before that she will sucicde if my brother will not marry her and we lodged a complaint against her.

You are explained two facts, 1. She was a affair with your brother; but she concealed that she is a married woman or now divorcee. 2. She threaten to your brother that if he is not solemnizing marriage with her, than she will be registered a false criminal case of rape or she will be committed suicide.You submit a representation to the concerned senior police officer; vide which you will be made a request for taking an action against that lady for your unnecessary harassment & threat given by her and also request to protection of your life and liberty for that lady; because apprehension is there for registration of a false case. if she has already been made an attempt to committed suicide than you have liberty to file a criminal complaint against her; before the competent court having jurisdiction. You have also remedy to file a petition before Hon`ble High court for you protection.
