Q: Can we make a new Will if we cannot find old Will

we had a will. it is lost. can we draft a new will without the old one?

Yes, a new Will can be drafted in super-cession of the previous Will by mentioning in the new Will that any Will previously executed stands cancelled. The effect shall be that even if the previous lost Will gets traced out, the same shall not take effect. The contents of the fresh/ new Will shall have an over-riding effect over the provision of the previous Will.



Q: Landlord not allowing to take stuff and not giving security as well

Got a divorce notice from husband. Dispute with husband now husband staying separate and the agreement is on his name. I told my landlord that i cant afford the same and gave a notice that i will be leaving by 31st december. Earlier they agreed, yesterday i received a call that they are denying to return the security deposit. I switched off my all my appliances and left by still my meter kept running and they are denying to return security and asking to pay rent to get my stuff out. Is there any legal action possible? If yes then what action?

Since the Lease Agreement is in the name of your husband, only he shall be in a position to initiate action for seeking the refund of the security deposit.We would need to examine the copy of the Lease Agreement for providing further advice in the matter.



Q: Procedure to add a new partner in partnership firm

Hi I need advice on adding a partner to my partnership and having a cross holding in the new partners firm. How can we enable this? What kind of paper work will be required?

Introduction of a new partnerIn terms of Section 31 of the Indian Partnership Act, 1932, a new person can be introduced as a partner into a firm with the consent of all the existing partners subject to the execution of a fresh Partnership Deed. At the time of execution of fresh partnership deed presence of all the existing partners along with the new partner and witnesses is essential. All the partners are required to carry the original copy of their respective Permanent Account Number (PAN) as well as residence proofs.The date when the fresh partnership deed is executed the previous partnership deed shall stand superseded. However, a person who is introduced as a partner into the firm does not become liable for any act of the firm done before he became a partner. Cross-holding in new partners firmCross holding across firms do not have any material effect on the ability of a particular firm; each firm being a distinct legal entity; except from competing businesses prospective.
