Q: bank recovering money from guarantor and not from loanee.

dear sir i was guarantor to one personal loan from co op bank.loanee defaulated payment bank proceed for recovary to registar office .order is pass to recover loan due from guarantor because guarantor is gove servant. loanee is available but bank is not recovering money because they have easy option that is from guarantor. what is temady for gaueantor.how he overcome from this problem. loane know everything but he just ignore the guarantor. suggest what to do.

Considering facts stated by you, Proceedings can be initiated before Debt Recovery Tribunal. However, facts given by you are insufficient. All the documents are required to be perused. It is also necessary to verify proceeding by bank against the borrower.

Q: Procedure for sale of joint property

hi we are a hindu family having a joint family owned property in Ahmednagar, Maharasthra, India. Sole owner died in 2001 & post sdeath the property was inherited by 7 children of the sol owner, 5 brothers & 2 sisters. My husband died in August, 2013. i have now retired & I need my share in the property. however out of the seven inheritants 6 of them do not agree as they prefer to sell the property at a desired rate which at this moment is a far-cry as the property prices arent great in the area in question. therefore I would like your support in resolving this dispute as I need an equal share in the property upon selling the same.

Not able to figure out, whether you are one of the sister or a widow of one of the brothers. However, you can get your share in the joint hindu family property, subject to your existing rights. (Perusal of Documents will give clear picture, enabling me to give proper legal advise/solution)
