we have a property dispute going on for few years at District court of west bengal. we are hindu. To get the justice faster, how can we move to Kolkatta High Court ? Thanks

First I need to know, what type of case is going on in High Court. What is the stage of that proceeding. I need to see what pleadings have been filed in the said proceeding. Only then can i say how to proceed to High Court. But generally, it is advised that if you want speedy disposal then you can always file a civil revision for expeditious disposal of the proceeding. Sir, First I need to know, is the construction made in your land ? How are you affected by such construction? Only then, I can give you a concrete advice. Because 144 only directs the police authorities to take care of the fact that law and order in respect to your possession is not hampered and the police authorities are directed to file a report. But I dont think it will really help you if you want to put a spanner in the wheel. For that you need, specific case made out within the scope of civil laws, before the appropriate civil court. Immediately file an Interim maintenance petition along with a divorce petition. 2. File an application for custody, as your child is of 2years, your sister can always get custody, subject to certain conditions. But whatever we have to do, we have do it quickly.
