Q: Transfer of joint property with municipal tax
Inherited joint property with 7 families. The property is in the name of Grand father who is no more but still property tax is in his name. Each family has been earmarked their share through a simple affidavit. I would like to separate my self. Whether I can split to have separate tax receipt of my share in municipality in Mumbai in my name. What is the procedure.. Thanking you, Sir.
Advocate Bhavik Salia answered
This depends on whether the property is divisible. If it is a separate flat in a building. i believe the same is possible. Do you have separate electricity bills? Approach the Assessment and Collection Department at the local BMC Ward office.
Q: possession of property which is rented for more than 15 years
Father owned one Building, wherein one flat is rented out for more than 15 years, decree passed for possession of the said property in his favor in the session, and district court. Now case is pending in High court, can he claim possession of the said property or rent amount deposited by the petitioner as directed by The high court.?
Advocate Bhavik Salia answered
By in his favour do you mean Father. If the appeal is admitted or if the appeal is not admitted and there is no stay on the execution proceedings. You can institute execution proceedings for recovery of possession and transfer of amount deposited in the court in your favour of the father.

Q: Refund from Mane Developers (not responding when asked to refund)
We booked a plot (Mane Palms in KARJAT) in 2015 with booking amount rs. 400000/= & the plan was abruptly cancelled. We want to get refund as soon as possible because the developer is not responding to us. Kindly give us suggestion to proceed further.
Advocate Bhavik Salia answered
I suggest you quickly raise a claim. If the payment was made before November, the matter for recovery is well beyond limitation period of 3 years. Contact a local lawyer at the earliest. Criminally, you can file a cheating case on the builder. Move ASAP as the matter is already beyond limitation.
