Q: Complaint seeking FIR against Police Officials and a Girl for Illegal

wish to lodge a formal complaint regarding serious misconduct, illegal detention, extortion and criminal intimidation committed by certain police officials along with a girl .On the said date and time, police officials came to my house and took me with them in a vehicle. I was brought to the police station but instead of taking me through the main gate, I was taken through the back gate and upstairs. I was taken through the back gate and upstairs. I was kept there under pressure without any law

Advocate Anup answered
To file such a complaint you need the assistance of an advocate who can assist you filing the complaint and suggest you the various laws under which this can be done. If you have not broken any law then check with the police if any complaint has been filed against you by the girl which you have mentioned above

Q: Ran away from police barricade

I was drunk and gave lift to someone and i saw barricade and i turned my car and tried to run the from the police constable because i was drunk and tremble. The police constable came in front of me and i ran from there. He was wearing camera and he must have recorded. I did not hit anybody and they also not chased me. What can be done by them now and should i be worried.

Advocate Anup answered
yes you should be worried because there can be a challan against you and even the police may impound the vehicle later. Though no criminal action was done but the police will file a charge against the owner of the car. if you are the owner then there might be case against you for disturbing the law and order

Q: Hindu freind's living relation with minimum ceremony marriage in JAIN

One of my Hindu friend was in living with a Jain boy and their family did a sindoor ceremony in closed doors and considered her as daughter-in-law and she had a child with that guy and and after 4 years she left the Jain guy as she was caught him with other women. Now she fell in love with a guy and married him in Arya Samaj and child is with her and child is bearing the first father's name in the document. will this 2nd marriage be a legal one Please suggest

Advocate Anup answered
if the first marriage is not registered then it is not valid...so the so called second marriage is the only legal marriage. however for the change of father's name in the documents the lady has to give an affidavit saying that the only marriage is that of the second marriage

Q: For Related To Change In Name In Document For Pension Payment Order.

My father passed away in 2021 due to Covid 19. My father was a an employee in a Public Sector Bank. My mother receives family pension every month after my father's demise. Now the name of my mother which was before marriage like Asha Taneja and after marriage is now Asha Manocha. All my mother's documents have the name as Asha Manocha which is name after marriage. Now my father and mother didn't get their marriage registered when they married in 1984. We need to get the name amended in Pension Payment order . But the bank is asking for marriage certificate which we don't have. Can you suggest which can be alternative documents for proof of marriage of my mother and father for changes in Pension Payment Order.

Advocate Anup answered
for the proof of marriage at that time the marriage deed as presented during the marriage function need to be there and an affidavit from the surviving family member where in the name of the mother can be verified

Q: For trivial reasons, should you complain or should you forget and move

Like let's say someone slaps you.Should you pursue it legally and try to punish the perpetrator or should you forget and move on?What would you do ?

Advocate Anup answered
slaping is an incident which falls under the criminal activity. it depends on you if you wish to pursue the case against the person or try to forget it. As a legal counsel I will suggest you to file a case or atleast send a legal notice so that the person understands the gravity of the matter otherwise moving on is for the people who are weak enough not planning to take any atep
