Q: I have developed a computer software how can I protect it
I have develop one computer software application for providing certain feature which is not published online. How can i protect it.

Indian patent law does not allow just a computer program alone to be patentable without any connection with hardware. However, it can be copyrighted by disclosing portion of the code, executables. Also, the user interface can also be protected by a separate copyright application. Also, proper protection of ip in service contracts is advised.
Q: Renewal of expired Trade mark less than 6 months
SirWhat is the payment required to be made for renewal of a trademark just expired a couple of months ago and on whose name has the draft to be made in Delhi zone.Please advise.Thanks.

Hi,You can renew the Trademark within a window of 6 months before expiry (without fine) to upto 1 year after expiry (with extra fee).Within 6 months of expiry, the fee required for renewal would be Rs. 8,000. The draft needs to be in the name of 'Registrar of Trademarks' payable at Delhi.Regards,Anshul Goel

Hi,You should get it drafted by a competent law firm so that all conditions are properly taken care of. e.g.1. Failure to perform obligations by ambassador.2. Length of term of agreement and Payment Terms.3. Renewal option and terms.4. What happens in case of frustration of contract.5. Duties on ambassador such as no negative comment about brand or superlative for competing brand.6.
