habeas corpus writ High Court ya Supreme Court mein file Hota Hai. wo bhi tabhi jab kisine Jabardasti qaid kar rakha ho. agar aisa hai to pahle FIR karwa dijiye. phir advocate se advice lijiye. agar wife apni marzi se mayke mein hai to family Court mein Restitution of conjugal rights ki application file kar sakte hain.

Being a muslim, I had court marraige with a punjabi boy in 2024 with.. But after marriage he said that we'll stay in our own houses for 1 year without letting our parents know that we have been married. Later on he said he will convince his parents for our marraige and bring me home. After 1year I asked him when you going to talk to your parents ? then he started giving me excuses by saying he has an elder sister our marraige news will create chaos, she will not get married if our marraige news gets spread out, also he said I won't be able to take a good care of yours as I'm financial not earning well, also my mother and father will never agree to our marriage, let's get separated. After hearing all this I went to talk to his parents about our marraige but his mother said that "beta nobody knows about your marriage with our son, why don't u get divorced"? I know my husband is good man but his family is manipulating him and want us to get separated.

if you had a court marriage, you have full protection of law. They can't force you to separate unilaterally. Tell your husband and his family members that they will face more problems if you take legal route. if they listen to you, it would be better for them. if they don't, you may contact an advocate and move the court for restitution of conjugal rights as well as maintenance. But you should immediately file an informatory petition before a magistrate so that it may help you later. No one will know about this. Later you may move the court if your husband and his family do not treat you fairly.

Q: Friend forcing me daily to return money which we lost in startup busin

I want to know whether I can file a claim that a friend of mine is torchering and harassing and abusing me on text to return part of his money which he has invested with me in a business startup, which was not successfull and now he is asking to return his part and also filed a cyber crime complaint against me, how will I get rid of this issue.

If the amount was an investment in a business with profit/loss sharing, and not a loan, you are not legally bound to return the amount unless there was fraud or misrepresentation. But there must be evidence that can show that it was an investment in business, and not loan. If the business failed due to market reasons, you won’t be liable. But, you should be able to show that it was not an implicit loan. Harassment and threats by messages amounts to criminal intimidation, insult or harassment. You have the right to file a police complaint with evidence (screenshots of messages). Since your friend has already filed a cyber crime complaint you should engage a lawyer immediately. Obtain a copy of the complaint/FIR, if available. Depending on the allegationthe cyber cell might be investigating under. If no fraudulent intent is present and it was a bona fide business failure, these charges are not sustainable. Keep records of all texts, emails, agreements, bank transactions. This will protect you if a criminal case proceeds. A lawyer may advise you to apply for Anticipatory Bail if FIR is lodged and help you draft a counter-complaint for harassment. You may also go to the local police station or cyber cell with screenshots of abusive messages and file a complaint. 4. Clarify the Nature of Business Agreement:If possible, issue a reply notice through your advocate clarifying that It was an investment, not a loan and that there was no fraudulent intention and that you’re being harassed and defamed wrongfully. Your advocate may advise you to send a legal notice to your friend for defamation, harassment, and misuse of legal process. Never engage in any retaliatory behavior or abusive communication. Always be correct and lawful in behaviour and keep records of other party’s unlawful behaviour. Hope it helps you!
