I'm wrongly accused with POCSO case misusing my daughter under threat by relatives and friends for different disputes I was in JC for about 80Days and out on interim bail which has been converted to a regular bail on the pretext of my daughters truthful statement to the regular session court tis hazari Delhi we are one unit and carry no disputes and my daughter and wife willing to give any statement to the court to get rid of this case immediately I'm raised and studied in USA I'm a biological scientist from California university USA Now in Delhi facing life threatening oral cancer and bipolar disorder biological ailments and facing starvation unemployed family suffering I'm looking for some one who can rap up everything for us can run through the emotions and feelings and stand for the occasion on humanitarian grounds I'm not looking for a very expensive advocacy someone who can selflessly come over and work for minimal amount with some token rest immediately on acquittal or quashing

Q: Is approval of all legal heirs required to free hold the property

I am married, and we are Hindus. My father died in april 1997, he had a DDA flat, my 2 brothers and 1 sister are legal hiers of the property, one of my brother wants to get it free hold in his name. I do not want to give my share to him, what should I do? Is it possible that he gets it freehold without me.

All the siblings are required to give and sign a duly notarized Relinquishment Deed and a No Objection Certificate. Further, in case the same are not given then the owners of the property can file a representation and ask for getting the property freehold.

Q: How to take actions against abusive neighbours

The person living opposite to our house always threatens us and abuses to our family and relatives. Too much aggressive that he starts fighting to people who are good to us. What to do because we are really fed up with all his crap. Everytime he just threatens us that he will get our home sealed, will get us removed from our job and last but not least he says, he has great links with ministers. We have been getting through all this from past 3 years. He start calling cops on his own and then tries to take us all along with him to police station.

You can file a complaint with the Resident Welfare Association which can further file a Police complaint. Or else you can take the help of a Lawyer and file a Police complaint. Even a complaint to a Magistrate is also feasible.

Q: How to get justice in false rape case?

A false allegation was made and FIR filed on 25.02.2016 u/s 376, 328, 354D & 506 against me. I got arrested on 02.03.2016 and spent 8 months in Tihar jail before getting bail from Hon. High Court of Delhi I had and still have all the proofs of my innocence like 300 emails and 4.5 months of whatsapp chats and 76 photographs and 4 SMS and 6 voice recordings of phone calls. Still I suffered and still suffering in trial court Right now, the cross examination of the complainant is over and she admitted all those evidences produced by me as genuine Please let me know if those are feasible - 1) I want a fast track court trial. I am getting dates of 2-3 months. I am financially bankrupt so can't afford to visit Delhi again and again from Kolkata 2) I want further cross examination of the complainant as she was avoiding answering many vital questions and evidences 3) I want immediate dismissal of case if complainant proved false beyond doubt and her punishment u/s 211

You can surely get the cross examination done but the case cannot be put on to a fast track. Further you can lodge a formal protest application in the Court. There is always an alternative to lodge a Counter Complaint

Q: Recovery of the Recruitment Services catered to the client

We are a Recruitment consultant and have assisted one of our client for their Hiring needs. For the same the consulting charges are due since last 5 Months and the client is now not responding to the calls / sms / Emails. What can be the ideal process to be followed. What are the chances of the recovery of the amount, the client has lost the entire Infrastructure project but are Operational with 7-10 employees now limited to their head office in Delhi How much time it will take to recover the amount though when we have exchanged the agreement it was not discussed about the charges post in case not done the payment of signed 30 Days Also the Jurisdiction was not specified as the client is in Delhi and we are Operational in Uttar Pradesh. what are the Charges for the services provided

You can send them a legal notice and can initiate legal proceedings against them including recovery proceedings. Further the chances can be assessed only once the entire documents are read and reviewed.
